- These Terms apply from the Commencement Date until the date that is the earlier of:
- the date the Services are completed (as reasonably determined by us); or
- the date on which these Terms are terminated,
(Term)
2. Services
- In consideration of you providing us with your Items, we will provide the Services and agree to pay you the Price, in accordance with these Terms, whether ourselves or through our Personnel.
- You are under no obligation to send us any Items after requesting a Selling Pack from us.
- Once we have received the Selling Pack from you, including your Items and the Valuation Form, we will test and value your Items. We will then provide you with an Offer via email or telephone to purchase your Items based upon the weights and purity as tested by our experts. If we are unable to reach you, we will continue trying to contact you whilst securely holding your Items
- Offers: Any Offer made by us is valid until 8pm the same day that the Offer is made. After this time, we reserve the right to revise the Offer to reflect changes in precious metal market prices. Gold prices are fixed twice daily (approximately 11am and 3pm), and significant price fluctuations may require us to adjust our Offer accordingly. You acknowledge and accept that this is due to the nature of the Items, being precious metals that fluctuate in value frequently.
- Testing: All Items will be subject to testing using non-invasive x-ray scanning equipment. However, we reserve the right to conduct additional testing where necessary, including:
- acid testing, which may cause minor scratches or marks to the Items; and
- filing into Items to test through any plating to the base metal, which may cause visible damage,
you acknowledge and accept that such testing may be necessary to verify the authenticity and purity of the Items (particularly gold items), and to the maximum extent permitted by law, we will not be liable to you for any damage caused by such testing.
- Gemstones and diamonds: Please note that gemstones (other than diamonds) generally have no scrap value for our purposes. We do not return gemstones or diamonds incorporated into your Items as a standard. Diamonds over 0.25 carats may qualify for additional payment at our discretion, based on size, colour, cut and clarity. Any such additional payment will be set out in our Offer.
- Gold plated items have no value for our purposes and will be treated as non-gold items. Items of no value will not be returned unless specifically requested by you, in which case the £15 administration fee in accordance with clause 2.8 (see below) will apply.
- If you reject our Offer, we will return your Items to you, subject to the following conditions:
- if the Items contain no precious metal or contain less than 10 grams of precious metal, a £15 administration fee will be charged to cover the cost of postage and handling for both receiving and returning the Items; and
- return postage will be by standard post, unless you agree to pay for upgraded postage,
you acknowledge and accept that the administration fee is a genuine pre-estimate of our likely losses incurred as a result of the Offer being rejected and/or the Items not meeting our criteria (for example, if you provide us with gold plated Items).
- If we are unable to contact you within 28 days of making an Offer using the contact details you have provided to us, we will continue to attempt to contact you during this period whilst securely holding your Items. If we remain unable to contact you after 28 days, we will automatically process payment of the Offer amount using your nominated payment method in the Valuation Form.
- If these Terms express a time within which the Services are to be supplied, we will use reasonable endeavours to provide the Services by such time, but you agree that such time is an estimate only.
- You acknowledge and agree that any information, advice, material or work provided by us as part of the Services does not constitute financial advice.
- All variations to the Services must be agreed in writing between the Parties and will be priced in accordance with any schedule of rates provided by us, or otherwise as reasonably agreed between the Parties. If we consider that any instructions or directions from you constitute a variation to the scope of the Services or our obligations under these Terms, then we will not be obliged to comply with such instructions or directions unless agreed in accordance with this clause.
- Silver items: We do not accept silver items unless they are sent together with at least 10 grams of gold. If you send us silver items without meeting this requirement, an administration fee of £15 will be charged for their return, or they may be disposed of free of charge at your request. You acknowledge and accept that the administration fee is a genuine pre-estimate of our likely losses as a result of the silver items failing to meet this requirement.

- Price match guarantee: If you have received a written quote from another online gold buyer, we may match their quote, subject to the quote being from a comparable online gold buying service (not a jewellery shop or pawn broker), you providing us with evidence of the other quote, and subject to any adjustments for fluctuation in precious metal prices between the date of the quote and the date of our Offer.
- All amounts payable by you under these Terms are exclusive of amounts in respect of any taxes, including sales, use or value added tax chargeable from time to time (VAT), unless otherwise stated. Where any taxable supply for VAT purposes is made under these Terms by us to you, you agree, on receipt of a valid VAT invoice from us, to pay to us such additional amounts in respect of VAT as are chargeable on the supply of the Services at the same time as payment is due for the supply of the Services.

6. Confidential Information
- Subject to clause 6.2, each Party must (and must ensure that its Personnel) keep confidential, and not use (except to perform its obligations under these Terms) or permit any unauthorised use of, information provided by the other Party, including information about these Terms and the other Party’s business and operations.
- Clause 6.1 does not apply where the disclosure is required by Law or the disclosure is to a professional adviser in order to obtain advice in relation to matters arising in connection with these Terms and provided that the disclosing Party ensures the adviser complies with the terms of clause 6.1.
- You acknowledge and agree that telephone calls between you and us may be recorded for training, security and quality assurance purposes.
- This clause 6 will survive the termination of these Terms.
7. Consumer Cancellation Right
- This clause 7 applies only to the extent that you sell Items to us as a “consumer”, as defined in the Consumer Rights Act 2015. You expressly agree to this information being provided and accepted in digital form, rather than on paper.
- Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers normally have the right to cancel distance contracts within 14 days of the Commencement Date (Cancellation Period).
- However, under the Regulation 28(1)(a), there is no statutory right to cancel a contract for the supply of goods or services where the price is dependent on fluctuations in the financial market which cannot be controlled by us.
- Accordingly, once you accept our Offer to purchase the Items from you, you do not have the right to cancel this contract if you change your mind. This is because the Price we pay to you is dependent on precious metals markets which fluctuate beyond our control. Such fluctuations may occur within the Cancellation Period. This exception is provided for under Regulation 28(1)(a) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- You do, however, have the right to choose not to proceed at any time before accepting our Offer (for example by choosing not to send your Items, or by rejecting our Offer when we contact you).
- Once you accept our Offer, title in the Items passes to us immediately in accordance with clause 4.6, and the contract cannot be cancelled.
- Nothing in this clause 7 affects your other statutory rights under consumer laws.
8. Liability
- Nothing in these Terms limits any Liability which cannot legally be limited, including Liability for:
- death or personal injury caused by negligence; and
- fraud or fraudulent misrepresentation.
- Subject to clause 8.1 (liability which cannot legally be limited), but despite anything else to the contrary in these Terms, to the maximum extent permitted by Law:
- if you are not a ‘consumer’ as defined in the Consumer Rights Act 2015, neither Party will be liable for Consequential Loss;
- if you are a ‘consumer’ as defined in the Consumer Rights Act 2015, and you use the Services for any commercial, business or re-sale purpose, we will have no Liability to you for any loss of profit, loss of business, loss of data, business interruption, or loss of business opportunity;
- a Party’s liability for any Liability under these Terms will be reduced proportionately to the extent the relevant Liability was caused or contributed to by the acts or omissions of the other Party (or any of its Personnel), including any failure by that other Party to mitigate its loss; and
- our aggregate liability for any Liability arising from or in connection with these Terms will be limited to 100% of the Price paid or payable by us to you for the relevant Items.
- This clause 8 will survive the termination or expiry of these Terms.
9. Claims Procedure
- If you wish to submit a claim to us regarding loss or damage caused to the Items:
- you must notify us as soon as reasonably practicable;
- there is a 14-day processing period from the time we receive the claim;
- in calculating the value for lost or damaged Items, only the scrap metal value will be considered, not any value for gemstones, rarity or resale value;
- the courier service may require you to provide comprehensive evidence and proof of value, including but not limited to photographs, written valuations, weights and purchase receipts; and
- we are bound to follow the decision of underwriters in the first instance. This does not affect your statutory rights to pursue a claim through other means if you disagree with the outcome.
10. Termination
- These Terms will terminate immediately upon written notice by a Party (Non-Defaulting Party) if:
- the other Party (Defaulting Party) breaches a material term of these Terms and that breach has not been remedied within 10 Business Days of the Defaulting Party being notified of the breach by the Non-Defaulting Party; or
- the Defaulting Party goes bankrupt, insolvent or is otherwise unable to pay its debts as they fall due.
- Upon expiry or termination of these Terms:
- we will immediately cease providing the Services; and
- we may retain your documents and information (including copies) to the extent required by Law or pursuant to any information technology back-up procedure, provided that we handle your information in accordance with clause 6.
- Termination of these Terms will not affect any rights or liabilities that a Party has accrued under it.
- This clause 9 will survive the termination or expiry of these Terms.
11. General
- Amendment: Subject to clause 2.12, these Terms may only be amended by written instrument executed by the Parties.
- Assignment: We may assign or transfer our rights to make payment to you under these Terms, provided that such assignment does not adversely affect your rights under these Terms.
- Contracts (Rights of Third Parties) Act 1999: Despite any other provision of these Terms, nothing in these Terms confers or is intended to confer any right to enforce any of its terms on any person who is not a Party to it.
- Disputes: A Party may not commence court proceedings relating to any dispute arising from, or in connection with, these Terms (Dispute) without first meeting a representative of the other Party within 10 Business Days of notifying that other Party of the Dispute. If the Parties cannot resolve the Dispute at that meeting, either Party may refer the Dispute to mediation administered by The Centre for Effective Dispute Resolution.
- Force Majeure: Neither Party will be liable for any delay or failure to perform their respective obligations under these Terms if such delay or failure is caused or contributed to by a Force Majeure Event, provided that the Party seeking to rely on the benefit of this clause:
- as soon as reasonably practical, notifies the other Party in writing details of the Force Majeure Event, and the extent to which it is unable to perform its obligations; and
- uses reasonable endeavours to minimise the duration and adverse consequences of the Force Majeure Event.
- Governing Law: These Terms are governed by the laws of England and Wales and both parties submit to the exclusive jurisdiction of the courts operating in England and Wales.
- Notices: Any notice given under these Terms must be in writing addressed to the addresses set out in these Terms, or the relevant address last notified by the recipient to the Parties in accordance with this clause. Any notice may be sent by standard post or email, and will be deemed to have been served on the expiry of 48 hours in the case of post, or at the time of transmission in the case of transmission by email.
- Privacy: We will comply with all applicable data protection laws, and your personal data will be handled in accordance with our privacy policy (available on our website).
- Publicity: Despite clause 6, you agree that we may advertise or publicise the broad nature of our supply of the Services to you, including on our website or in our promotional material.
- Relationship of Parties: These Terms are not intended to create a partnership, joint venture, employment or agency relationship between the Parties.
- Subcontracting: We may subcontract the provision of any part of the Services without your prior written consent. We agree that any subcontracting does not discharge us from any liability under these Terms and that we are liable for the acts and omissions of our subcontractor.
